Just to make this abundantly clear for all the self-appointed copyright cops out there, I didn't write Incendia, which was used to create this fractal. I didn't come up with the fractal formula. I didn't create the images used for textures/materials/gradients or theimages used for Dmaps in it. And the background is apparently created from a publicly available tutorial. It is NOT however a "cut and paste" theft from that previously unknown site as some have alleged. If one looks close (say at the top left corner), they will notice that it isn't even the same image. I don't recall where I got this background image (folks send/give me lots of stuff), but that doesn't mean I can be automatically labeled an art thief by someone else who *also* doesn't know the circumstances in which I obtained it, much less the source of the exact image. Considering how much I've given to the fractal/DA community, I find the charge highly insulting.

2nd UPDATE:
Just to be as clear as possible, I've re-done this image with the previously unknown image made by Vlad Gerasimov ([link]) so that I can have an identifiable source for every little piece of it. The new background came from him and is used with his written permission. The eleven textures and Dmaps used in the piece are part of Incendia. Aexion gets the credit for those. If anyone thinks there is no credit left for me, I don't care.

Daniel is a very honest man. He never abuses the system. His firm belief in Christianity would not allow him to deviate from the path of truth and the very thought of him using someone else's work is a joke to myself and all those who have known him for several years.

Funny you should say that. I almost didn't post it. I liked another recent piece better. For that matter, I like a LOT of my other pieces better. LOL But guess that is why many of my other recommended pieces never got a DD or 3,000+ views. Different folks like different things.

The water drops are not part of the fractal, but part of the background. I've already had my chops busted once today for not making it overly clear that the background came from a publicly available tutorial. [rolls eyes]

Nice work, it is very reminiscent of the AquaNox universe (it's a largely ignored game series in a post-apocalyptic setting with an amazing story). It's like you made it that way on purpose :D

no offense but do you regularly use images you didn't make in your deviations? Regardless if you know where it came or not, its called art theft. I know this was a public tutorial, but its a tutorial meant for you to recreate it as your own...not copy the final image.

This may be an honest mistake but I'm still reporting this as it violates the terms of copyright which I must fight for as it protects us all as individual designers.

Do I steal other people's art? No. If you go back through my gallery, I consistently reference not only the programs I use, but any scripts as well. But as was recently posted, looks like the image came from a freely available tutorial. Hardly a case of me ripping off something that someone was trying to keep private. If it is that big of a deal, I could re-do it with a *different* random placement of droplets on it if it makes you feel any better.

its not that fact that its a tutorial, its the fact you did not create it.

If you followed the tutorial, bravo. Your originality isn't 100% but at least you put the effort. The background in this is a huge part of the design. Its clearly copy/pasted. That is what I am upset about...

I'd just like to say as one of the people here in the forefront of supporting anti-theft and copyrights here at DA, that Daniel is not a thief, but a giver of many of his parameters here for all to use. I in no way condone copyright violation...which is obvious if you read my sig and go back through my journals on the subject.

We are all human and this was a human oversight to not state it so that it gave comprehensive credit and to suit you...by giving the credit to the original.

While I am an avid supporter of anti-theft of art.....I do believe there are occasions for tolerance when one has, through some human oversight, missed giving proper credit....especially when the person is a decent, good person who meant no ill will.

Sometimes people don't know ALL the copyright issues and I do try to educate and exercise tolerance, when people make the proper changes in credits - BEFORE - reporting them. That's what good and just people do. I hope you will reconsider reporting what is a simple human failing by a good member of the fractal community who meant no malice.

Thanks, Anita. If this guy was more interested in the facts and less in bloviating, all he would have to do is look at the placement of the "water drops" in the top left corner to see that the image I used may be based on Vlad's tutorial, but is NOT a copy of the ending example he posted. He keeps up with his groundless accusations of art theft though and I'm likely to damage my Christian testimony in defense of my integrity.

I understand that this deviant has a good reputation. I know it was a mistake under his behalf, but getting mad at me for pointing out the truth won't make it any better.

A tutorial is a set of instructions to follow. The final image is created and placed there so you can see the end result. This is not open to file>save as and use wherever you want. I don't have a problem with people using the methods involved in a tutorial. The fact is, the background was completely and entirely created by someone else.

If everyone had a folder where they just saved images on it and then used them later, would the excuse "I forgot where they came from" be good enough if you were to discover them in their deviations? No. I understand you may have a good relationship with this deviant, but regardless...ripping is ripping.

I have admitted the background and lots of stuff in the image isn't my own creation. It came late, but it is there. I took tools, including images, created by other people and used them. But there is a difference between me neglecting to mention that the background image and images used as "materials" in the fractal are not original to me and accusing me of outright cut-and-paste theft of Vlad's image. Just look at the top left corner of each image. They are not the same. And even if it were his image, you have no knowledge of whether or not I have his permission to use it except for my word that it didn't come from him - and you've already shown that you don't trust my word. So the only thing I am guilty of is not clarifying to people that don't know me that my only artistic talent is in fractals. Regardless, just know that I don't "steal art" as you allege. And I've decided that your opinion and assumptions on that fact isn't going to bother me. Anger is just going to make my disability worse and not going to change any minds. So I'm sending all the dA Love to you that I can. I corrected the issue every way I can. I appreciate the reminder to mention what parts of the image were original and which were borrowed or came in the program I used. Rest assured that it is a lesson that won't easily be forgotten.

If you will re-read my note you will see there was NO anger in it...merely statements. And my point of view has nothing to do any "good relationship" with anyone here. As a mature person, I'm quite capable of separating the difference. I will call anyone out on ripping - and have.

I just believe that FIRST educating someone in a cautionary manner - is a much better way to approach an oversight. I haven't found a perfect person yet, so we all have oversights. It's when someone REPEATS behavior that is unacceptable - that they have been educated about - that warrents reporting. I just don't believe in taking a sledgehammer to kill an ant...that's all...education is far more effective and long lasting.

I have had a LOT of work stolen and I FIRST try to educate. If someone doesn't listen and keeps stealing...then I pull out the sledgehammer. Yes...he should have credited it.....but we ALL have made mistakes in our lives and we'd all be dead if everyone took a sledgehammer to us the first time we did something wrong. I just believe in treating people with decency - until they prove they are not worth it. Very simple tennent to live by.

I never claimed to create the background. The background is obviously not a fractal. I just created the fractal. And I did it with a program that I had nothing to do with creating and some textures that I had nothing to do with making. It used fractal formulas and Dmaps that were also created by others. Did I credit all of them? No. I don't even know who all of them are. It was *probably* *Aexion, and I credited him and linked to his page. I'm sorry this is so upsetting to you, but I'm used to a fractal community that actually shares ideas, gradients, tutorials, scripts, and so forth. I've written tons myself and make them freely available for others. I've even posted thousands of parameters for free for anyone that wants to use them and tweak them. I don't put watermarks on my stuff or anything like that. I know not everyone is as generous with their stuff. Sounds like you are not. But my memory isn't good, your knowledge of the events isn't omnipotent, and if prior history is any indication, this came from a friend or a public source and I had permission to use it. I even go to the extra mile to ask people if I can use their images as my personal wallpaper. So excuse me if I don't get as worked up over this as you seem to be. I do my best. If you still think I'm some kind of art thief, so be it. But before you make a lot of assumptions about me, check out my journal where, a while back, I wrote specifically about this topic and when attribution should be given and not and asked for a consensus among those that did what I did.

look, I understand you give to the community. I do myself. I create tutorials, make resources and I know when I am justified. Mistake or not, this is your fault and I'm pointing it out justly. You did not follow the tutorial (a tutorial is mean to FOLLOW not copy/paste the end result into a derivative work).

I don't really care how you obtained the photo or if you give credit. You did not have permission from the original author in the first place to copy/paste his final result into your deviation. It was a mistake, but you clearly are missing the point. And your arrogance on this matter only makes you look worse no matter how "giving" you are or were in the past.

Your whole accusation is based on an erroneous assumption. If you look closely at the end result of that tutorial that I had no knowledge of, you will find that the *premise* is the same, but the image is different. You *assume* I took it from there. I didn't. I'd never been to that site. You *assume* I didn't get permission for using it. It's an assumption, not a fact. The fact that I can't disprove your assumption doesn't make it fact. You are right that I didn't originally specify that the background of the fractal was different from the fractal itself and I am only a fractal artist, but that has been corrected now. If that is now sufficient for you, you are welcome to continue coming across like a bitter, jealous rival.
